1. Conditions of use
Overview
This website is operated by Terraflo™. By accessing and using this site, you agree to these terms of use. If you do not agree to these terms, please do not use our site or services.
We reserve the right to change these terms at any time. It is your responsibility to review them regularly.
2. Copyrights and trademarks
The name "Terraflo", its logo and product designs are trademarks and copyrights protected by applicable laws. Any reproduction, distribution or modification without prior written authorization is prohibited and may result in legal action.

3. Prohibited uses
It is strictly forbidden to use this site for :
Any illegal activity;
Infringement of intellectual property rights;
Downloading viruses or malware;
Unauthorized collection of personal information;
Harassment, defamation or discrimination;
Disruption of safety measures.
Any violation will result in suspension or termination of access to the site.
4. Terms of Sale, Payment, Cancellation, and delivery
Payment and deposit
The balance is due no later than 14 days before the estimated date of delivery or pickup.
All deposits are final and non-refundable. They guarantee the reservation of materials, production scheduling, and the delivery window.
Changes and cancellations
No changes may be made to the model, engine, or major control components within 30 days prior to the estimated date of delivery or pickup. Additions may be made if the items are in stock. Any cancellation within 30 days prior to delivery or pickup will result in a $2,000 fee.

Due to the seasonal nature of our deliveries and factors beyond our control, the date of delivery , or pickup may vary slightly (up to 30 days before or after the estimated date). Terraflo is not responsible for delays caused by events of force majeure (extreme weather conditions, supply issues, etc.).
Terms and Conditions of delivery
The customer must ensure safe and unobstructed access to the site at delivery or to the pickup location. The customer will be responsible for any delays or damage resulting from inadequate access. Any additional time spent on site will be billed at a rate of $150 per hour.
5. Liability and risk
Ownership and responsibility for the product are transferred to the customer upon delivery or pick-up. Terraflo declines all responsibility for any accident, injury or damage occurring during or after delivery or pick-up, including those resulting from inadequate access conditions or misuse.
6. Warranty
6.1 Warranty pontoon dock
2-year limited warranty on structural components.
15-year manufacturer's warranty on float buoyancy.
This warranty covers only manufacturing defects under normal use and excludes damage caused by misuse, improper installation, unauthorized modifications, or extreme environmental conditions (storms, vandalism, etc.).
6.2 Parsun Motor Warranty
2-year limited warranty.
This warranty covers only manufacturing defects under normal use and excludes damage caused by misuse, improper installation, unauthorized modifications, or extreme environmental conditions (storms, vandalism, etc.).
Steps to Follow: Parsun Motor Warranty
Step 1. Remotely Diagnose the Problem
First, we ask the customer to clearly demonstrate the problem to us, usually by recording a short video: turn on the engine, try to start it, and show us what happens or what isn't working.
This step is important because it allows us to observe the engine's behavior and the actual symptoms of the problem.
Step 2. Attempt to diagnose and troubleshoot remotely
Based on the videos, photos, and information provided, we analyze the situation and try to identify the cause of the problem and, when possible, resolve it remotely with the customer.
Step 3. Engine Inspection
If the problem cannot be identified or resolved remotely, we will take the necessary steps to have the engine picked up and inspected more thoroughly.
Step 4. Repair or replacement, if necessary
Once a diagnosis has been made, if a repair or replacement is required and is covered by the applicable warranties, we will take the necessary steps to perform the repair, replacement, or any other appropriate solution.
7. Handcrafted Quality and Natural Variations
Each Terraflo pontoon is handcrafted with care and attention to detail. Since each pontoon is handcrafted, there may be slight variations or imperfections from one pontoon to another.
Since wood is a natural, living material, it may exhibit variations in color, grain, texture, and shade, as well as small natural imperfections, such as knots, marks, surface cracks, or surface variations. These characteristics may also change over time due to exposure to sunlight, water, and the elements.
These variations are inherent to the natural characteristics of wood and the handcrafted construction of our pontoons. They do not constitute a manufacturing defect and do not compromise the quality, strength, or functionality of the boat.
No two Terraflo docks are exactly alike. That is precisely what makes each of our creations unique.
8. Returns and Refunds
Sales are final for products that have been used, installed, or put into service. No returns or refunds will be granted simply because of a change of mind, dissatisfaction with the product’s use, or after the product has been used for a period of time.
However, this policy does not limit the legal warranties applicable to products sold in Quebec. When a product has a defect or issue that may be covered by an applicable warranty, the situation must first be evaluated in accordance with the applicable warranties.
9. Protection of Personal Information
Data collection and use
We collect your personal information solely for the purpose of providing our products and services, and to enhance your customer experience. The data collected includes: name, e-mail address, telephone number and postal address.
Security
We implement technical and organizational measures to protect your data, including SSL encryption and firewalls. However, Internet transmission is never totally secure.

You can access, correct or request the deletion of your data by contacting us at info@terraflo.ca.
10. Photo and Video Consent
By agreeing to the in- delivery or pickup service, you consent to photos or videos being taken during installation or delivery, which may be used for marketing purposes unless you request otherwise in writing.
11. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of the province of Quebec. Any dispute shall be submitted to the exclusive jurisdiction of the Quebec courts.

Terraflo reserves the right to modify this policy and its conditions at any time. The most recent version is always available on this site.
